There have been dramatic events at Milimani law courts on the impeachment of Deputy President Rigathi Gachagua case.
Attorneys allied to Gachagua have raised serious issues on the validity of the bench to listen to the petition filled claiming they were not properly appointed.
In their submission, they said Chief Justice Martha Koome is the only person with authorities to constitute a bench and by deputy chief Justice being the one who appointed the sitting bench, it was unconstitutional.
Well, while adjourning the court session. Judge Eric Ogolla ordered the following to happen within an hour.

The judge has ordered those representing Deputy President Rigathi Gachagua to file a notice on if they want to bench to be removed in the case of Gachagua.
The case will resume at 2PM. Kenyans will now have to wait and see what happens going forward. The case is expected to be determined today and if the outcome flavours the government. Then, Professor Kithure Kindiki will be sworn in as a deputy President of the republic of Kenya immediately.
Kindiki was appointed by President William Ruto and approved by the national assembly. However, his swearing in process was stopped by the courts in Kerugoya and Milimani. Judge Chacha Mwita directed that the process be halted until the case is determined on October 24, 2024.
The lawyers representing Deputy President Rigathi Gachagua have also asked the courts to move the hearing to Thursday so that the ruling cannot nullify any other petitions within Others courts.
