Kericho County Governor His Excellency Eric Mutai is a man under siege again. This is coming just a few weeks after surviving two Impeachment motions at the Senate on technical grounds.
Members of the Kericho County assembly vowed to go after him again despite being Saved by the Senate and well, they have actualized their threats and this time round. They have found a special way to frustrate him.

The Notices of Motion for the removal from office of six Kericho CECs by way of impeachment were successfully tabled on the floor of the County Assembly of Kericho this afternoon.

The six CECs are:
- CEC Health – David Ekuwam
- CEC Finance – Jackson Rop
- CEC Roads and Public Works – Brendah Bii
- CEC Water – Philemon Kurgat
- CEC Lands – Joseph Korir
- CEC Agriculture – Magerer Lang’at
The County Assembly is expected to either form a Select Committee to deliberate on the impeachment motions or handle the matter in plenary.


If a Select Committee is formed, it will investigate the allegations, hear the CEC Members, and report back to the House within 10 days. The Assembly will then debate the report in plenary and take a vote.
If the plenary route is chosen, the whole House will conduct the hearing, listen to the CEC Members’ defenses, deliberate on their cases, and then vote.
Unlike the impeachment of a Governor or Deputy Governor, the two-thirds rule is not required to impeach a CEC under the County Governments Act. A CEC is considered impeached if the motion is supported by a simple majority of all Members of the County Assembly.
Kericho has 47 MCAs, meaning a simple majority is 24 members.
If the CECs are impeached, the Speaker of the County Assembly will communicate the resolution to the Governor, who is required to dismiss the CEC Members. The Governor cannot overturn the decision of the County Assembly.
Only the courts can overturn the impeachment of a CEC… not on the grounds themselves, but if the procedure was violated. If the Assembly followed the law to the letter, the courts will not interfere.
