The impeachment of Rigathi Gachagwa might be on the way as per those close to the president. Honerable Oscar Sudi remarks on X about Gachagua dismissal has added more Speculations on when he will be removed.
Sudi alleged that in two weeks time, the second in command will be removed from Office.Something that triggered Wamuchomba to ask for a clarification on what exactly his sentiments meant. Well, incase it happens, Chief Justice Martha Koome has been told what is coming and why he must prepare.
Martha Koome has been told how volatile impeachment will be and legal obligation that will come with it. It is going to be a tough day for the courts and the judiciary System in total. She has been advised to be prepared of challenges that are coming ahead.
“The impeding impeachment of the deputy president will be challenged at the High Court, Court of Appeal, and Supreme Court. This case will generate intense public interest and political pressure on judges, second only to a presidential election petition.”
“It will be a true test for the independence of judges, CJ, and the judiciary. It will probably be determined by 5 judges of the High Court, 5 or 7 judges of Appeal, and the full Supreme Court bench. Mps who support the impeachment should think through the legal and political consequences of such an action before drafting. Judges are human beings; they watch the happenings in the political landscape, albeit in silence.”
“If the DP is pushed out by ‘force’ or ‘crass’ disregard of legal processes- they will quash the impeachment, and the DP will emerge stronger. Remember, there is a hidden right in the Constitution – the right to hold office after being elected. It is in the Bill of Rights. Taking away such a right has legal consequences. “
This means the DP will not be impeached on marketplace allegations and political rumors – there must be an impeachable offence. Proponents of motion will be required to conduct meaningful and qualitative public participation whose product will be juridically tested.
