Court Announces New Decision In Gachagua’s Case After Intense Submissions

The day of push and pull was today October 22, 2024. Kenyans witnessed high votile submissions at Milimani law courts when Gachagua lawyers took on Judges handling his case.

In their submission, they claimed the bench was unconstitutional since it was formed by Deputy Chief Justice, instead of Chief Justice Martha Koome.

In their argument, it was against the constitution for Philomena Mwilu to constitute a bench at night when Koome is available. To the counsel leading Gachagua defence, that was unfair and equally to violation of their clients rights.

Well, after an intense argument during the afternoon session. Justice Ogolla has issued directions on what happens next.

Justice Ogolla has issued a direction on Gachagua case. According to him, the bench has decided that they will issue a statement on whather they will rescue themselves from the case tomorrow. 

The motion challenging their presence on the bench was filled by those attorneys representing Deputy President Rigathi Gachagua who argued it was against the law for Mwilu to constitute the bench when Koome is available to do so.
