Justice Yuvinaris Angima finds himself in an unenviable position—presiding over
a legal Gordian knot that would test the patience of Solomon himself.

Before him sit four separate cases, potentially involving the same Sh 100 billion
Paradise Lost property, each with its own cast of litigants, lawyers, and labyrinthine
claims spanning decades.

One might gently observe that the learned judge inherited this conundrum rather
than created it but higher courts than his had decided on this issue, so whats the
interest?

The Mbari ya Mbogo case has wandered the corridors of justice for seventeen years—
long enough for a child born at its filing to now be preparing for university.

The questions swirling around the Milimani Paradox—whether cases already determined
are being relitigated, whether forum shopping is afoot, whether the Environment
and Lands Court is being used as a casino where litigants spin until they hit the
jackpot—these are systemic questions that transcend any single judge’s docket.

Justice Angima’s order to exchange documents represents a measured, sensible first
step. Rather than rushing to consolidate or dismiss, he has asked the fundamental
question: are these cases actually related? It is the judicial equivalent of asking
everyone to show their cards before betting further.

Whether this represents wisdom or merely delaying the inevitable is a matter for
appellate courts and legal scholars to debate.

The gentle truth is this: a judge cannot single-handedly untangle a knot that has
been tightening for seventeen years. Justice Angima did not create the conflicting
titles, the allegations of presidential grants to phantom companies, or the abatement
of ELC No. 557 of 2009.

He inherited a legal ecosystem where, practically if not legally, it sometimes appears
there are two High Courts in Kenya, one that decides matters, and another that entertains
them anew.

The spotlight, cast gently, reveals not a villain but a jurist navigating an institutional
crisis.

The real question is not why Justice Angima accepted these cases, but why Kenya’s
judicial system lacks robust mechanisms to prevent the same property from being
litigated ad infinitum.

Until that systemic question is answered, judges like Angima will continue to preside
over legal labyrinths, doing their best to find threads of clarity in a tapestry
of confusion.
