Law Society of Kenya (LSK) President Charles Kanjama has maintained that former Deputy President Rigathi Gachagua remains eligible to contest for public office despite a recent High Court ruling that upheld his impeachment, arguing that the legal process is not yet complete until all avenues of appeal have been exhausted.

Speaking shortly after the court’s landmark decision, Kanjama emphasized that Kenya’s legal system provides individuals the right to challenge court rulings through higher judicial forums, and that Gachagua’s political future cannot be conclusively determined before the appeals process is finalized.

According to Kanjama, the High Court judgment represents only one stage in a potentially lengthy legal battle. He noted that Gachagua still has the option of appealing the ruling at the Court of Appeal and, if necessary, seeking further intervention from the Supreme Court.

“The principle of justice requires that all available legal remedies be exhausted before a final determination is reached,” Kanjama stated. “As matters stand, the impeachment ruling does not automatically close the door on his political ambitions.”

The remarks come amid heightened political debate following the High Court’s decision to uphold Gachagua’s impeachment, a ruling that has generated mixed reactions across the political divide.

Supporters of the former Deputy President have insisted that he remains a significant force in national politics and should be allowed to pursue elective office if the law permits.
